Is it legal for a waiter to take the coins from my change without asking...?

...when the waiter brought back my change from paying my bill, he rounded down my change to the nearest dollar, not bringing me back my coins (did this for my friends as well). Is this legal for him to do, not giving me exact change for my bill?
